Changes to Tenancy Rules – What Tenants & Owners Need to Know.

The NZ government has introduced some key changes to the Residential Tenancies Act (RTA), with some significant changes taking effect from 2024 and in 2025.

These updates aim to create a fairer, more transparent rental market for both property owners and tenants. At Rentlink, we’re committed to keeping you informed and making these transitions as seamless as possible.

Here’s a breakdown of the key changes and how they impact both tenants and owners:

1. Online Bond Lodgement – Faster and More Efficient (Effective December 17, 2024)

All bond lodgements and payments must now be processed online. This means that signatures are no longer required for bond lodgements or top-ups, though they are still necessary for refunds and other transactions.

Why It’s Beneficial:

  • For Owners: Faster and easier bond lodgement with reduced paperwork.
  • For Tenants: Quicker processing means bonds are lodged and refunded more efficiently.

2. Simplified Termination Rules – More Clarity & Flexibility (Effective January 30, 2025)

Owners will now be able to end a periodic tenancy with 90 days' notice without needing to provide a specific reason. In cases where the owner or a family member intends to move in, the property has been sold, or it is needed for employees/contractors, a 42-day notice will apply. Additionally, fixed-term tenancies will automatically convert to periodic unless either party gives notice between 90 and 21 days before the end date.

  • For Tenants: Greater stability and predictability in rental agreements.

3. Modernised Communication & Tribunal Changes (Effective March 20, 2025)

If an email address is provided in writing or used for communication, it can now be used as an official address for service for up to two years after the tenancy ends. The Tenancy Tribunal will have the ability to make decisions based on written applications and documents without requiring a hearing in certain cases, except for tenancy terminations or right-of-entry disputes.

Why It’s Beneficial:

  • For Owners: Easier communication and streamlined dispute resolution.
  • For Tenants: Clearer rules on communication and faster resolution of issues.

4. Enforceable Smoking Bans

Tenancy agreements that include clauses banning smoking indoors (except in outbuildings) are now enforceable by the Tenancy Tribunal. If an owner wishes to ban smoking elsewhere on the property, it must align with the tenant’s right to quiet enjoyment.

  • For Owners: Helps maintain property value and prevents smoke damage.
  • For Tenants: Clear expectations on smoking policies reduce disputes.

5. Supporting Tenants Affected by Family Violence

The new amendments explicitly cover a tenant’s children or dependants under protections against family violence.

If a tenant or their child experiences family violence, they can withdraw from the tenancy with two days’ notice (with qualifying evidence) without financial penalty.

  • For Owners: Ensures properties are vacated respectfully while supporting vulnerable tenants.
  • For Tenants: A legally supported way to leave unsafe situations.

6. Pet Ownership Rules (Effective Date TBC)

Tenants will only be allowed to keep a pet with written landlord consent. Landlords can refuse pet requests only on reasonable grounds. Additionally, tenants will be responsible for pet-related damage beyond fair wear and tear, and a pet bond of up to two weeks’ rent may be required once the provisions come into effect.

  • For Owners: Greater control over pet-related damage and potential pet bonds.
  • For Tenants: A clearer process for securing pet-friendly rentals.
